I have been working with a co as sub contractor for a year, done 100.000 in my sprinter, guy was always slow, every week
Paying, no invoice so i could not reconcile, now, he hasnt paid me at all and doesnt answer phone, im left with no money, (he owes about 1,000) whats best course of action (legal) he about 70m from me

This is what ajm posted on another thread a wile back. Never had to use them myself tho one client does owe me alot of money similar amount as you. I have started a paper trail of when i email or call them if it then ends up in a small claims court i have a trail of what action i have taken.

You should always invoice who every you do work for weather that be your customer or if you have had a job sub to you from another courier company, also PODs signed by who every is accepting the delivery, keep all paper work.
as Drivers R Us says its the paper trail proof you have done the work

3440I have to say if you haven't done an invoice then you can only blame yourself, I wouldn't pay without an invoice it's your business you have to run it properly, nobody in this world pays without an invoice unless it's dodgy, the best thing you can ddo. S contact them and sort it out good luck.

751I would download the smalls claim court paperwork

Id then fill it in. I would then send a copy of this filled in paperwork to the defaulter explaining that you will be sending this in if the bill is not paid within 7 days. When/if it is then not paid id simply post it off and have your day in court. Dont forget you can also claim for a days pay plus interest on any money outstanding
Do make sure your paperwork is unquestionable as the court will rip it apart to be assured your not making it up. Do turn up even if the other party does not as this will almost certainly guarantee you winning the case plus you can then seek to enforcement action straight away ( no prisoners ) while your there .

1701I hope you succeed in getting your payments but i have to say not only is it costly but with all the info on lots of courier forums its a mistake that shouldnt have happened, its an amateur mistake and one you should have not made if you had done enough research before hand. 751A tip for the future, scan all paperwork you get signed as a matter of course. This is crystal evidence when it comes to pay time in a court of law.

3179Small claims court is ok, Yes you will get a judgement but is can be difficult to enforce as the Bailiffs will only go out if it's worth it to them.
As it's over £600 go straight to the High Court Sheriffs service. They have more powers and if it's a debt at a business address they can enter without a warrant.

Yes, and the 2000 included all the people that needed weeding out, and who you and others were complaining about.
As I've said before, the number at the top of the directory is the number of people we think are suitable for showing on the directory listing, as they have been spoken to before being allowed to join, and they have logged in recently.
The directory is not a list of everyone whose details are on the system, it's a selected number from the total membership at the moment you happen to go into the directory.

There are app's available that you can use to invoice direct from your smart-phone I normally do an invoice straight after the drop or at least sameday so its on my fone, its a good habit to get into

A bit off topic, but nearly 10,000 have ever joined, so we have to decide who to show in the directory on any particular day, and who not to show.
I'd say you would agree it's right that we:
Don't show those who we haven't seen for 3 months (though we would show them if they logged in again tomorrow).
Don't show those who joined but repeatedly didn't answer the phone when we called to check them out. (Actually the majority of all people who join don't answer the phone when we call).
Don't show those who "are just researching being a courier".
Don't show people who are actually end users.
Don't show those who fail our checks for lots of other reasons (e.g. They are just getting their van and insurance sorted in the next few weeks and want to do it in the car for a bit, or they want to do it at the weekends around a full time job).
Don't show people who have left the industry so ask us not to show them.
Don't show people who have gone bust, or have a persistent bad payment record to the point where they're more trouble than they're worth (same with poor delivery performance).
Don't show those who refuse to put a full name or address on their profile, or who generally don't look right.
Don't show people who we hear (reliably) aren't good for the reputation of mtvan, or are just here to troll the site.

Hope this clears it up. As many many people on here have said many times, it's better to have quality than quantity, and that means not showing everyone.

Love em or hate em the expert is definately the number 2 site right now - very difficult to get a job off the site because there's so many members competing for the same jobs - but credit due where its deserved the expert pays on time all the time so your not left thinking will i get paid end of the month - im currently chasing 2 members of mtvan for overdue invoices
